Platform Role and Intermediary Position
For the purpose of these Terms, “LocalBikri”, “platform”, “we”, “us”, and “our” refer to the LocalBikri platform operated by LBEMarket Solutions Pvt. Ltd., unless the context requires otherwise.
LocalBikri provides an electronic platform for product discovery, listing display, order transmission, communication, and coordination between independent customers, independent sellers, and independent delivery agents.
LocalBikri is a technology facilitator and marketplace-style intermediary only. It is not the seller, retailer, distributor, importer, stockist, warehouse operator, manufacturer, franchisor, commercial agent, or co-seller of any goods offered on the platform.
LocalBikri does not own, possess, control, store, test, inspect, package, dispatch, or take title to listed products. LocalBikri does not employ delivery agents and does not operate an in-house logistics fleet.
LocalBikri may enable or display different payment, collection, or transaction-completion workflows depending on product category, location, seller settings, operational rollout, or feature availability, but does not become the seller of goods by enabling such workflows.
User Categories and Independent Status
The platform may be used by the following user categories:
- Customer: An individual who browses, places orders, or purchases goods directly from a seller through the platform.
- Seller: An independent business or individual that lists goods, sets prices, accepts orders, collects payment, and fulfills transactions.
- Delivery Agent: An independent individual or seller-managed resource responsible for physical delivery or order handoff.
Each seller and each delivery agent acts in an independent capacity and not as an employee, representative, partner, or agent of LocalBikri.
Contract of Sale and Product Responsibility
When a customer places an order and the seller accepts or confirms that order, the contract of sale is formed directly between the customer and the seller. LocalBikri is not a party to that sale contract.
The seller is solely responsible for product ownership, lawful right to sell, title, description accuracy, price, discounts, expiry, merchantability, safety, packaging, storage, taxes, invoices, category-specific licenses, warranty statements, and after-sales service.
Any claim relating to wrong product, counterfeit product, damaged product, defective product, expired product, missing quantity, unsafe product, or product that is illegal or restricted must be pursued directly against the seller, subject to applicable law.
Payments and Transaction Handling
Payment methods, collection mechanics, and transaction flows made available on LocalBikri may vary based on location, seller availability, product category, platform rollout, and operational settings. Certain payment options may be unavailable in some areas, for some orders, or at some times.
Where a payment or transaction status is displayed on the platform, that status is informational and may depend on seller input, customer action, delivery confirmation, or an external payment channel or service provider.
LocalBikri is not responsible for payment failure, fraudulent QR codes, unauthorized transfers, duplicate payment, short collection, overcharge, counterfeit cash, change disputes, chargebacks, reversal failure, settlement delay, failed remittance, non-issuance of receipt, or reconciliation issues arising between customer, seller, payment service provider, delivery agent, or any third-party payment channel, except to the limited extent expressly required by applicable law.
Listings, Catalog Accuracy, and Verification Limits
Each seller is solely responsible for product descriptions, pricing, taxes, offers, stock levels, regulatory disclosures, images, and listing accuracy.
LocalBikri may review, moderate, delist, or restrict content, but LocalBikri does not guarantee that any seller profile, identity detail, license detail, product description, stock display, ETA badge, delivery badge, pricing field, discount label, or catalog image is complete, current, authentic, or error-free.
Any limited verification, KYC, document review, badge, or onboarding review carried out by LocalBikri is discretionary and does not create a representation, warranty, or guarantee regarding seller identity, solvency, authority, regulatory compliance, or product authenticity.
Delivery and Independent Agent Model
Delivery is handled by the seller or by independent delivery agents engaged, supervised, or authorized by the seller. Any person collecting payment, OTP, signature, or acknowledgment at handover does so for the seller and not as an employee or representative of LocalBikri.
Any estimated delivery time, speed badge, fast delivery marker, express marker, availability indicator, or route-based estimate displayed on the platform is informational only and is not a guaranteed service level.
LocalBikri is not liable for delay, failed delivery, partial delivery, damaged packaging, theft, tampering, route deviation, harassment, assault, OTP misuse, cold food, wrong handoff, false delivery marking, or any delivery incident caused by the seller, delivery agent, customer address issues, force majeure events, traffic, weather, device failure, or operational constraints.
Cancellations, Refunds, Returns, and Disputes
LocalBikri does not issue refunds, process replacements, collect returns, reverse direct seller payments, or adjudicate product quality claims in the ordinary course.
All refund, replacement, cancellation, return, shortage, wrong-item, damaged-item, expired-item, missing-item, billing, or non-delivery claims must be handled directly between the customer and the seller in accordance with the seller’s policy and applicable law.
If the platform provides a cancellation button, chat, order timeline, or support ticketing interface, that functionality only transmits communication or status information. It does not mean LocalBikri has accepted liability, approved a refund, guaranteed reversal, or assumed the seller’s legal obligations.
Fraud, Misuse, and Account Security
Users must provide accurate account and order information, maintain the security of their credentials, and not disclose OTPs, passwords, payment approvals, or verification codes except as required to complete a lawful transaction.
Users must not engage in impersonation, fake orders, fake reviews, collusive ratings, false shortage claims, payment manipulation, coupon abuse, illegal listings, counterfeit sales, harassment, threats, or any fraudulent, abusive, or misleading conduct on or through the platform.
LocalBikri is not liable for losses arising from account compromise, SIM swap, phishing, fake support outreach, OTP misuse, unauthorized orders, or fraudulent acts of customers, sellers, delivery agents, or third parties. LocalBikri may investigate, suspend, block, cancel order transmission, preserve records, or cooperate with law enforcement where fraud or misuse is suspected.
Suspension, Compliance, and Information Sharing
LocalBikri may suspend, restrict, terminate, delist, disable content, block users, cancel or freeze order transmission, or require additional information if it reasonably believes a user has violated these Terms, misused the platform, created legal or operational risk, or harmed other users or the platform.
LocalBikri may retain, review, and disclose relevant information, logs, chats, contact details, order records, delivery status records, IP data, and complaint records where required by law, regulatory direction, court order, or for fraud prevention, safety, or legal defense.
Nothing in these Terms requires LocalBikri to mediate every dispute, recover funds from a seller, guarantee evidence preservation by a third party, or continue providing platform access to any user.
Platform Availability and Warranty Disclaimer
The platform, all content, all listings, and all functionality are provided on an as is and as available basis.
To the maximum extent permitted by law, LocalBikri disclaims all warranties, representations, and guarantees, whether express or implied, relating to uninterrupted availability, merchantability, fitness for a particular purpose, title, non-infringement, data accuracy, security, seller conduct, delivery outcomes, or transaction completion.
LocalBikri does not guarantee that the platform will be uninterrupted, error-free, secure, timely, compatible with every device, or free from outage, cyberattack, malware, or technical failure.
Limitation of Liability
To the maximum extent permitted by law, LocalBikri and its affiliates, founders, officers, employees, contractors, and service providers shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential loss or damage.
This exclusion includes loss relating to product issues, adulteration, expiry, seller misconduct, delivery agent misconduct, payment disputes, fraud, cyber incidents, refund denial, service interruption, business loss, lost profits, loss of reputation, personal inconvenience, or reliance on any listing, badge, ETA, inventory status, review, or representation made by a seller, delivery agent, user, or third party.
Without prejudice to the foregoing, LocalBikri’s aggregate liability arising out of any claim relating to the platform shall not exceed the lower of INR 1,000 or the platform fees, if any, actually paid by the claimant to LocalBikri in the three months immediately preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded under applicable law.
Indemnity
Each user agrees to defend, indemnify, and hold harmless LocalBikri and its affiliates, officers, employees, agents, and service providers against claims, complaints, notices, actions, penalties, losses, liabilities, refunds, damages, taxes, costs, and legal expenses arising from that user’s conduct, listings, products, services, payments, deliveries, policy violations, regulatory non-compliance, fraud, intellectual property claims, bodily injury claims, or breach of these Terms.
Governing Law and Jurisdiction
These Terms are governed by the laws of India.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Jammu, Union Territory of Jammu and Kashmir, India.
General Legal Terms
LocalBikri may revise these Terms from time to time. The updated version becomes effective when published on the platform unless a later effective date is expressly stated.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force to the maximum extent permitted by law.
LocalBikri’s failure to enforce any provision on one occasion shall not operate as a waiver of that provision or of any other provision. Clauses relating to platform role, disclaimers, limitation of liability, indemnity, records, payments, fraud, and governing law shall survive suspension, termination, or discontinuance of platform access.
